Surname on P45 wrong - old company unwilling to re-issue

Hi, 
My daughter has just had her P45 from her 1st job - it has her known as surname on, not her legal surname. 
when we contacted them they said all her paperwork was done in her known as surname - it wasnt as all her ID is in her legal suname - birth certificate, NI number and bank account
she needs the p45 to be correct to be able to provide it as id for her enhanced dbs check 
any advice would be great

    If she needs this for a DBS check, whenever I've had to do DBS checks it asked for ALL KNOWN names, so the fact this was in her KNOWN name should be fine.  My work name and 'home' name are different and never caused issues, you just list every name you've ever been known by.

    As per 74jax many people have different legal*, work and home names - it's not unusual.  My wife is a solicitor and regularly uses both her maiden name (for work and official purposes)  and her married name for other purposes including purchasing stuff - even though all her cards are in her maiden name.  It's only once been a problem when she was buying plane tickets and nearly bought them in her married name rather than her passport name.

    Many female doctors also use both names because they don't want to change their GMC registration details when they marry.  (Or at least that's what more than one doctor told me when I worked in the NHS).

    *Incidentally, there's no such thing as a "legal" name.  You can legally call yourself what you want, although it helps if you have some sort of evidence (eg marriage certificate or legal deed) that ties them together.  So long as the correct NI number is on the P45 and the DBS are aware of both (or more) names that she uses, there shouldn't be a problem - or at least not one that can't be explained.  (There's nothing necessarily suspicious in using more than one name so long as you can explain why or link them together.  Is there some underlying reason why she doesn't want it known - like being on a witness protection programme or something?)

    The only time its been an issue for me was abroad hiring a car.....  My passport and driving licence are in different names and it was totally my fault, but I didn't spot the driving licence had to be in the same name as the passport....... I never got to hire the car........ But that taught me to double check!

    OP - as long as all names are put down, I think you'll find it goes through ok.  It's not to catch you our or anything like that, DBSs are straight forward and as long as you complete fine you will be ok. 

    Even if she does get a P45 in the other name, she would still need to list both names anyway as she is known by both.

    The employer won't re-issue a P45 because they are not allowed to.  They are absolutely correct to refuse - and must surely have been using that name for all their dealings with her.

    Her P45 will show her National Insurance number which will cross-match with the information she provides on her DBS form.  So, no problem.

    The P45 is correct if they are using the surname by which she is known. Her NI number, not her name, is the 'unique identifier'.
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!
