48 Hr Opt Out?

Hi, I am registering with this agency but it's asking me if I want to opt in or out of this 48 hr, I don't want to work more then 48 hrs because of my mental health, which do I tick?

Do they have a form which asks something like "Do you want to opt out or opt in to the WTD 48-hour provision?" If so, you do not want to opt out. In fact you don't "opt in" as you are automatically covered by the provision unless you actively opt out.
I would just cross through the wording. If you really feeled pushed into ticking something, tick "opt in".
ETA By the way, not opting out doesn't mean they can't ask you to work more than 48 hours in any one week but, equally, as it is an agency, you don't have to work excess hours.
[Most employers like employees to opt out because it means they (the employers) don't have to keep records of hours worked and which also covers any work the employee undertakes, whoever it is for.]

Even if you do opt out it doesn't mean you have to work more than 48 hours a week. Employees are ten a penny at the moment, by ticking the opt out button you may be seen as less flexible than someone who ticked it, especially to an agency.0

Wrong way round - ticking an opt out button (if button it be) would mean you are willing to work over 48-hours. If you don't opt out, you won't get any work. Workers rights in this joke country are paper only, they are worthless in the real world.That I'm afraid is the reality of the sort of jobs these agencies offer, if you don't think it is for you, you're applying for the wrong sort of work.0

Signing it doesn't mean that you will do 48 hours. I've signed the opt-out in every job I've had in the last 20 years but don't think I've ever done a 48 hour week. It's just there to give both sides the flexibility to do so if required.0

Point to note, it is 48 hours averaged over 17 weeks. Not individual weeks.
