Hi All, looking for some advise for my daughter who is in the process of divorce after her husband had an affair and left the family home.
they own two flats, one is buy to let and the other is the family home she shares with 2 children. they have decided that he will keep the buy to let and she will stay in the family home with the kids until such time she is able to get a job and look to a new home, when they sell the flat she will be given all monies in equity after the mortgage has been paid. her husband is sole name on mortgage and deeds, he is now trying to force her onto his mortgage so she can be added to the deeds. given she is unemployed at present has no savings as he controlled the finances and left her with nothing in the bank and it is unlikely that the mortgage lender will consider her as joint mortgagee and they also have to approve her addition to the deeds. my question is this ;
can he do that given she has "home rights" anyway ?
can he lump in the mortgage as part of any spousal/child support ?

He can’t force her onto a mortgage if she doesn’t agree to it or the lender won’t accept her.
He doesn’t have to provide rent free accommodation in addition to child maintenance so yes he can lump the mortgage payments in unless there is a court order that he must pay it.
Is your daughter claiming all the benefits she is entitled to and is the correct amount of child maintenance being paid?0
