partner landed with csa arrears.

Hi,
My partner just had a letter (yesterday) from csa stating he owes over £3000 in arrears, and has 5 days to pay it in.
His ex says she doesnt get money from the csa so where has it come from?.
They seperated 9 yrs ago and finally divorced in 2005. They have 2 kids, (ex has 2 more with 2 other men). They had a personal agreement for weekly payments until 2005 when ex decided to cancel it and go bankrupt. Ex now claims all the benefits available to her while we have had to struggle without help, I have not worked for 2 yrs after being made redundant and I dont claim job seekers allowance and have a daughter who's father never paid money to csa for because we had a personal agreement.
My partner always pays money for anything the kids ask for, we even take them on holiday abroad. They come to stay with us and have no decent clothes with them so end up going clothes shopping with them.
Where on earth does all the money go to??

Sorry to hear of your problem.
If the lady is on benefits, then the CSA have to get involved as part of her claim. They will require 20% of your husbands net weekly salary for 2 children, however this will be reduced by 1/7th for every night the children stay with you.
Unfortunately benefit claimants don't get to see the full amount your husband will pay. She will only get an additional £10 a week.
If the lady has been on benefits since 2005, I would imagine the arrears have built up since then.
Try and get a full breakdown of the account first to see where the arrears have come from and check that you agree with their calculations as they do make mistakes.
To keep them away from threatening balliffs and stuff, you might want to consider offering a nominal payment that you can afford to show that you are willing to pay any money that you do owe, and you're not just trying to wriggle out of it. Sometimes that works.
Do keep in touch with them and try and sort it out amicably, otherwise they can send balliffs or do a deduction of earnings order which can be up to 40% of your husbands wage taken at source. They did that to us so we had to take a loan out to pay them off as the loan repayments were cheaper than losing 40% of his salary.

Don't pay immediately, and definitely don't think of taking out a loan to fund it. Is the sum accurate? I have never heard of the CSA getting an arrears calculation right and there's virtually no possibility that this one is correct.
You have a right to know how it was calculated and the way to find out is to appeal. Demand to know exactly how they have calculated it. Get them to show you their working. Appealing will also buy you a bit of time to find out how to pay if you eventually have to. Whatever else you do, never, ever give them your credit or debit card details. Putting that kind of information in front of people like the CSA is like giving Kate Moss access to this year's entire cocaine harvest.Information is not knowledge.

Sorry - I badly worded my post. I was thinking of arrangements where children stay over regular, such as friend has his daughter every Friday and Saturday night.Here I go again on my own....0

Hi The most important thing to do is to keep in touch with them - always get names of who you have been talking to. As someone said ask what period these arrears cover etc to make sure its not for the same period your partner has already paid directly to his ex. He should have bene made aware or the amount at the time. You should also make sure the assessments in place are the correct amount. If there are arrears owing as long as you offer an acceptable amount this will be accepted. Is the case now closed or is there regular maintenance to be made as well? Just for info Credit and debit card details are not ever recorded on the child support agency systems only the system used for making the payments and cannot be accessed at all after the payment has been made.Comp Wins 2011 : Cant wait to start listing everything:j:j:j0
