Hi guys
I need a quick bit of advice. I declared myself bankrupt in 2009 and as my home was in negative equity I was allowed to remain in it. The problem is now that I am on an interest only mortgage that will soon be coming to the end of the term and need to sell my property to be able to pay it off. I know that a bankruptcy restriction has placed in the title register that prevents me from selling. So what I'm really trying to find out is what my options are if I can't stay and I can't sell.

Have you run a recent search on the Land Registry? It shouldn't show any bankruptcy restriction as the restriction should have been removed when the Official Receiver re-vested it (i.e. relinquished any claim over it). The OR has no claim on the property now in any case as they only had 3 years in which to deal with a family home.
Do the Land Reg search (costs £3), and if the restriction hasn't been removed then contact the Insolvency Service for them to action it.0 -
I did a search yesterday and it showed the restriction below:
"(08.01.2009) BANKRUPTCY NOTICE entered under section 86(2) of the Land Registration Act 2002 in respect of a pending action, as the title of the proprietor of the registered estate appears to be affected by a petition in bankruptcy..."
Is there any way it can be removed? I tried to call the official receivers but the number from the correspondence I received back then no longer works.0 -
The OR should have informed the Land Reg when they revested the property. Find the office who dealt with your bankruptcy here and asked them to do it:

I would suggest getting your word processor out and writing a few letters. The longer you leave it, the more pressure you will be under when you need to remortgage0
