Wedding deposit refund

We were due to get married last October, but due to COVID , we moved the date to this September. As the situation is still unclear and the venue can’t guarantee that we will be able to cater for the 50 guests we agreed , we asked for a refund on the deposit we paid , which they have refused . Does anyone know what our legal position is ?? We haven’t signed a contract , all we have is a schedule of proceedings and acknowledgment of the deposit . Grateful for any advice
