Marriage Allowance

I see that in most cases, you need to earn under 50K to claim Marriage Allowance, with your partner paying no tax.
I have earned roughly £53K from PAYE, and made a self-employment loss in my side business, along with pension relief, when I view my calculation on self-assessment, it says
that I'm not a higher rate tax payer (presuming as the loss and other relief has made my income sub 50K) - does that mean I can claim the Marriage Allowance.

  • No, no one can "claim" Marriage Allowance.

    Your spouse may well be able to apply though and if you (and she) are eligible you would get a £250 reduction in your liability.

    If you do not pay higher rate tax in a tax year, your spouse/civil partner can choose to transfer 10% of their personal allowance to you. It is only worthwhile them doing it if they won't otherwise use all of their personal allowance.

    Thanks both, so it does mean my wife can claim to transfer her 10% to me, even though I earned 53k through PAYE?

    Yes it does, subject to what we have said above. It is your overall taxable income that counts, not one element of it.
