I have an old Bank of Scotland 8k debt that i defaulted on in 2012 , it was than sold on to Idem Servicing in june 2015 and since then i have had a payment plan in place for £59 a month which i have stuck to and have not missed a payment but now finding it burden financially due to COVID-19 .
I did request a CCA from them some years ago and got the reply not available and agreement is not enforceable etc
The default has long since disappeared from my credit file and no mention of it at all on my file .
So what can IDEM do now if i was stop paying ?

well now over 18 months later the debt has been bought by Hoist Finance who have started hounding me with letters so i sent them a cca which amazingly they have produced a poor quailty copy of my original application form with my name mis spelt and some reconstituted terms and conditions .Bit bemused how IDEM could not fulfil a CCA request but the company they have sold the debt on to Hoist can ?Not sure on my next steps.0

You had an unenforceable debt, by sending another CCA request, you could have suddenly turned it onto an enforceable one, luckily, an application form is not a credit agreement, so nothing has changed.
What you should have done was quote previous events, no CCA etc, never send more than one request per debt.
Your next step is to write and tell them an application form is not a credit agreement, so the status of the account remains unchanged.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
