marriage allowance now husband owes HMRC

Hi all, my husband made a huge mistake. Husband applied for marriage allowance and for the claim to be backdated as far as the tax year 2016-2017. However, I did not work 2016-2017 or 2017-2018 and now HMRC has sent my husband a letter saying he owes them income tax nearly which is £600 for those two years, despite me not earning anything.  Anyone made this mistake and not had to fork out £600? Husband thought that if he applies for the claim to be backdated HMRC would not count those years where I didn't work. HMRC does pick up calls either. Is there a chance for this to be rectified, can I write a letter or something to head office.

    It's the person who doesn't use all their tax allowance who applies to have part of it transferred to the spouse who is the one who is a tax payer. When you weren't working was the perfect time for you to be applicable. I suspect as he applied then some of his allowance was transferred to you meaning he owed more tax. What are your tax codes as that would help clarify.

  • Yes your husband has made a mistake.

    The person who applies for Marriage Allowance can only ever pay the same amount of tax or more, never less.

    It sounds like you should have applied and before applying you need to establish which years are worth while applying for.  HMRC do not check if it is worthwhile, they just check if you are eligible.  Two individuals both earning £20k are eligible but it isn't normally worthwhile applying.

    Yes that's correct. If we contact HMRC is there anything that can be done? Or is there a letter that we can send to head Office? 
  • You need to phone and speak to them when you are both available.

    You will need to cancel the original application and you, not your husband, need to make a new application.

    You need to know which specific tax years you want to apply for before phoning.  HMRC will not tell you which years to apply for, that is for you to decide.
