BA data breach compensation

Hi all,
I've recently seen adverts about registering with a company that are trying to get compensation for people affected by the BA data breach. "No Win, No fee"
Normally when i following Martin lewis advice i would do try and claim the compensation myself, but i can't find any information about how to do this.
Do you think it is best to go through this company. They have had adverts on tv and been in articles
www.badatabreach.com

Thanks!

Send BA details of your losses (with as much supporting evidence as you can) and sort it with them directly.

What losses have you had as a result of the data breach?

Your losses can be 'material' (actually losing money, property) or 'non material' (distress). Without material losses there have been very few successful claims across the EU, as this is dealt with by the company being fined, rather than individuals bringing claims.
  • @FaceHead - non material. So exposure of personal details including credit card numbers etc.
I'm only enquiring as this article said it was worth applying for compensation. Just wanted peoples thoughts.
    Thanks :)

The claims companies are mainly aiming to just build a suckers list for future use.  They know there is very little chance of any mass compensation, but they use your details for future fee paying activity.

Personally, I wouldn't put my name down on it.
  • They often end up trying to get you to pay towards some form of insurance or just chuck loads in and see if BA will pay some token sum. If you feel you have a loss then quantify it (with evidence) and complain to BA direct.
  • Sorry to hijack this thread but thought it would save a new one. We also had our data taken during the BA breach, which then led to our credit card being cancelled while we were away abroad on holiday. It didn't cause us any financial loss as we had another card with us, but did cause some stress and work getting a new card issued and it did limit what we could potentially spend on holiday as we now only had half our credit limit. Is it likely to be worth claiming? I too am wary of joining the class actions that are advertised when you Google.

You actually have a stronger case than most people as it led to an action that caused difficulties.  You may have had an alternative but having your primary card cancelled whilst you are on holiday and having to restrict spending would be considered a difficulty.

Agree that this is a better claim for non material damages than the OP, but I'd suggest that the most likely outcome is that you'll be landed with a hefty bill for costs from the other side when you don't win. I'd certainly not be taking action on this one.

Perhaps some of privacy charity might want to pick it up to test the boundaries of non material damages claims.
