My misunderstanding, con woman is executor along with someone else I never heard of.
Also in the will there is an expression of wish, is this legally binding?
i.e. for the lodger to continue to occupy the room providing he keeps paying an appropriate licence fee.
This is what is worrying me most. He is 64 and looking forward to retirement.0 -
do you know if this lady has any involvement with mental health services or social services?
does she have capacity?
does she have power of attourney or lasting power of attourney? the legislation has recently changed due to the mental capacity act which has recently been inforced. if she has memory problems then lasting power of attourney should have been put into place but sometimes it is not.
does she have any home carers or anyone involved in helping her? as they may be aware of if she is under any services, although they may not be able to discuss certin things with you due to confidentiality, they should take your concerns seriously.
You could always contact the financial onwardsman for lasting power of attourney (i think thats what they are called) and i think this is done via court of protection (will try to clarify for you as its early morning and my cogs are not ticking over yet) they have people who investigate concerns, such as they visit unexpectedly, ask for proof of spending, check bank accounts ect, they are responsible for checking the people who are looking after peoples finances have therr best interests at heart and i am 99% sure they can overr rule any decisions made and if they establish there are some concerns and the person at present managing the money is not fit to do so they can challenge it, take it of them, and apply for an appointeeship (for people who say have no family) which can mean social services can manage that persons finances.

Are you saying that an employee of a bank is transacting on an account held with the same bank? If so, then I would be getting in contact with the banks special investigations department too, in my workplace I would not be allowed to do that to be honest as it causes too much of a conflict of interest. If she is using the POA account for her own ends then the bank becomes liable for the fraud. If for instance, I were to be the POA holder on an account and put a direct debit of my own on that account, its classed as illegal and fraudulent.

Does the son know about the will and the executors? As you will see from the news, if someone leaves property to people outside their family, it is almost impossible to overturn a will if there is a relationship (friendship etc) between the beneficiary and the donor. Unless all parties agree.
Can we now go back to the managment of this old lady's affairs?
You say that the friend brings the old lady her money? What else does she do for her? is their any legal documentation.
Is ther a power of attorney, Enduring Power of Attorney in place? Is the old lady complete compos mentis?
