Daughter has had court papers through from capquest today, for very catolog, she has not paid for 5 years, and cant afford anything to even start to pay it off, she says she doesn't care if they give her a ccj, she needs options,
offer court what she can afford, but it will be silly offer,
dont do anything and let court give ccj,
what can they do to her if that happens..

Hi,I think the time for a provit letter has now passed, what exactly do you mean by court papers ?Is it a letter before action, or a full blown claim pack ?Good advice here, please read carefully -

had a solicitor letter and then court paper pack.0

also it says on papers that a default was served, but checking credit files there is no account for this dept0

Non of that is relevant now, things have progressed to a court claim, to which strict timescales must be adhered too, so she must deal with this as a matter of urgency or risk a default judgement.Included in the claim pack is an income/expenditure sheet, list everything she spends money on, whats left is the offer to the creditor, remember, its the creditor who will either accept or not, all the court does is issue the judgement, nothing more.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
