Married but name not on mortgage

I have been married for some years but my name is not on the mortgage. I transfer money monthly to my husband and although I don’t pay a great deal towards the “house” running I pay a great deal to the running of the family I.e clothes, food, classes etc. My husband says it doesn’t matter as we are married however I am not convinced and seem to think my name should be on the mortgage if I am paying for the “family”. Would someone be able to advise me, if we are married would this be the case that everything is 50/50 even though my name technology is not on the mortgage ?

  • I think it’s a lot more complicated than 50/50 if you’re not on the mortgage, you will have some rights I’m sure due to being married.

    If it is not a "short" marriage, the starting point in divorce would be 50/50.

    That’s not true. They could have got married whilst the owner already had £100k’s worth of equity in the property. Assets before and after separation do not count in divorce proceedings, only time spent together married (not even as a couple pre marriage) 

    Is the case in Scotland anyway.

    50/50 is the starting point of the division of marital financial assets. Though other factors will play a part in the final outcome. Consult a family law solicitor for a full understanding of where you stand.

    Was there some reason that you weren't put on the deeds and mortgage? 
    It can lead to problems if a marriage is in trouble - the sole owner could mortgage the house to the hilt, get rid of the money or even sell the property and reduce the amount to be shared with the spouse.
    You can register your interest in the property so that you will be informed if there are any changes made to the ownership -
