Hi,
received a similar letter from Barclays Recoveries. All seems a bit vague. Have read the Statute barred debts and the Limitation Act as posted by sourcrates.
Thing is I have had contact with Barclays on PPI but the debt was managed by a debt collection company so there was contact. Barclays have now taken back management of the debt.
If the debt is now unenforceable and Barclays have now taken back the debt does this mean the debt can then be sold onto another debt collection company?
The letter, for me, does not offer enough information on the cause and effect of the loan now being unenforceable. Had the loan been left with the debt collector I'd be happy to carry on paying but I hate Barclays for the mental stress they put me through over the years.
In 2019 Barclays created another false loan account and instructed Wescot to recover it. The loan never existed. Wescot sorted that out with a small compensation but nothing from Barclays. No acknowledgement, nothing.
Should I contact Barclays? Should I do nothing? Should I pay Barclays the amount I pay the debt collection company?0 -

They state the debt is unenforceable, so it’s up to you what you do.
They cannot do anything should you not pay, so it’s your choice.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. OK.
What would be the consequences of contacting Barclays? I still owe the loan though.0 -
There are no consequences either way, yes the money is still owed, but you can’t be taken to court for it, so as I said, it’s entirely your choice what you choose to do.
All Barclays can do is ask you to pay, the debt is already defaulted, so your credit file can’t suffer any worse than what it is now.
If you “want” to pay it, make arrangements to do so, if not, just walk away.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. OK, thanks for the input. I feel compelled to pay will think it over. I have no interest in what state my credit rating is.
Cheers.0 -
Refreshing to see an honest and moral person on this forum, rather than people asking questions how to (or being given advice on how to) avoid paying their debts using technicalities, kudos to you Sweatysock, I hope your future is brighter

That letter is exactly the same as mine, I too have decided to pay Barclays the same as I was paying before.I have set up a standing order to make the payments.0
