Good news ! Those buildings without cladding will no longer need an EWS1 form to buy, sell and remortgage.
Hope this helps those in the same situation as me, which my new build does not contain any cladding and just balcony only. But got cancelled because of A3 option on EWS1 form.

  • probably. but not sure about balcony. I read somewhere stated if the flat has balcony, it might fall straight to A3.

    I'm buying a new build flat which has no cladding anywhere and is under 18m high - the EWS1 form is a B1, as the balcony is made, in part, of wooden decking. Which seems a bit mad to me to point out the bleeding obvious that wood is a 'potentially combustible material', but at least I even have a valid EWS1 form. This latest news hopefully negates it anyway!

    Good yes - except I've found out today the valuer isn't accepting the form because the person who signed it off doesn't 'have the correct qualifications' so the lender won't accept it.

    Which is insane because there's about 50 flats in this development which have been sold, using this exact EWS1 form, with people living in them this very minute. So why is my lender saying the form has incorrect qualifications when every other lender for every other flat seems to be happy with it?

    Literally no idea what to do now, seems to be some kind of stalemate between valuer and developer.

    Oh no. This is terrible. Totally understand how you feel. I applied Skipton for my flat and got cancelled due to this EWS1 A3 rating, but they previously approved other applicants from the same development but different building. I don't understand how all these works. I felt there isn't any consistency in this. 

    Perhaps try another lender? Or probably try find out what lenders the other tenants are using and approach them.

    Yeah it's a bit mad really. The developer has told me this morning they're working on getting another signatory - I don't know how long that will take =/

    Can't use another lender - this is my only shot. I'm self employed and buying SO and they're literally the only lender that will accept me. This or nothing! Gah.

    aiks. Really annoying. Hope they can speed up the process and you can get your home soon.
    I was stuck too, tried with 3 lenders, not successful due to the rating. This is my 4th application, applying with Leeds this time. Hopefully I can get it soon 🙏

    Sadly, this announcement was rebuffed by UKF director the BSA - they did not consent to be included in it before Jenrick posted it.

    Your building might still require EWS1 for most lenders due to attachments (balconies).

    *EDIT TO ADD* I just saw you're going with Leeds, me too! Best of luck. Here is their criteria as it pertains to EWS1: https://www.leedsbuildingsociety.co.uk/_resources/pdfs/intermediaries-pdfs/lbs_cladding_on_flats.pdf so if the balconies have e.g. timber or composite decking, it will very likely require it. I'm guessing the A3 means it does (generally, BS8414-approved aluminium decking is the component on balconies that won't need it, very few modern developments have it though, because it's expensive AF and developers usually go for the cheaper compliant option).

    are you buying flat as well? I have been applying since July, been through different lenders. It is really a nightmare for me.
    What is your status of application with Leeds? I just submitted last Friday through my broker.
