Ex-partner/Loan in my address/is he still connected?

My ex-boyfriend took a loan out when he lived with me - it's my property, my mortgage, he is not on it at all, he moved in after a few months but then I kicked him out when we broke up. It wasn't a healthy relationship, long story short I ended up being the guarantor for the loan, which I am now trying to get out of (any help with this would be greatly appreciated!)
I have since found out he owes alot of money to many people, I've had debt letters come to my property for him. I've been told he is linked to my address because he was on my council tax, albeit very briefly. How do I check that he's not "linked" to my address anymore? Will this affect my mortgage? How do I stop any further correspondence coming to my address for him? Please help!

  • I would think you are linked through being a guarantor for his loan - there is a financial connection there.
    It may affect any remortgage but not your existing one.
    The only way to stop being a guarantor is for you to py off the loan - is he making the repayments>? Have you been called to make any?
    Credit files are linked to individuals not addresses.

    You dont get financially liked just because you have both lived at the same address at some point (or even currently). To have the kind of linking you are concerned about you must share a financial product like a bank account or loan (being a named card holder equally doesnt count on a credit card). 

    So the council tax wont create a link and the fact he may have some things still at your address isnt an issue either (from a credit referencing perspective). However the being a guarantor for a loan is likely to have created a link which will persist whilst the loan is open and your named on it.

    If you feel you were coerced into signing as the guarentor, there are things you can do.
    The Debt Camel site is run by a solicitor, the advice they give is excellent, my suggestion would be to have a good read through it, see if you have grounds for being removed as a guarentor -

    Oh dear.  What you will find is that, in reality, you took out a loan and are fully liable for it.  
    I am now trying to get out of (any help with this would be greatly appreciated!)
    Unfortunately, unless you were coerced in being the guarantor, there is no get-out.  Neither the ending of the relationship or you deciding you no longer want to be a guarantor give you a get-out option.

    He may well be but you cannot access his details to check.  The fact that you are still receiving mail for him suggests that he is.  Him being associated with your address will not impact your mortgage but, come re-mortgage time, the guarantor loan you have may well have an impact.  As for his mail, just stick it back in the mail box marked, not at this address.   
  • Thank you for your comments - I have gone through Debt Camel to appeal about the loan. I was coerced into being guarantor and it is not affordable to me. They didn't ask for any evidence of my income or expenditure, it seems all they saw was I have a mortgage. I didn't have a choice, he was financially abusing me and I had nothing left so he was hanging this over me, as if he was going to "save me". It's with the FOS now so I'm just waiting on an outcome from them. 
    He isn't paying the loan so they are chasing me to pay it. I have sent them bank statements and pay slips so they can see I do not have the money to pay it. I just have to wait now.
  • As above, living at the same address doesn't mean you are automatically financially linked - credit files belong to individuals, not addresses.

    Check your credit reports from all 3 CRAs - Experian, Equifax and TransUnion. Make sure there are no accounts listed that you don't know about (ie. he has taken out additional debt in your name). Additionally, check if you are named on any joint credit accounts (utilities, bank acocunts, loans, etc) with him - that is what will "link" you. If there are none of those on your files then you will be okay.

    The guarantor loan is a different story, however you seem to be taking steps towards dealing with that. Worst case scenario is that you have to take responsibility for that debt, but that should be the only thing. Debt collectors will be sending mail to "his" address because that is where he was last known to live. Don't open it and return anything sent to him as "return to sender - no longer lives at this address" - that's not your problem.
