Overtime rate cancelled due to sickness later in month.

I work part-time 2x 12 hours a week in a care home run by a large corporation. My contract states I work 2x 12 hours a week but I get paid monthly.
Last month I did overtime over the course of the first 3 weeks which added up to just short of 36hrs which is meant to be paid at time and a quarter. I then hurt my shoulder which meant
I couldn't do the last 3 shifts of the month. My employer has stated as I didn't complete my allocated hours for the month I'm not entitled to the enhanced overtime rate, but my contract sets out my working hours on a weekly basis.
Could I use this as a valid reason to complain?

I'm not familiar with what is considered usual in care home T&Cs, but are you sure you get paid an enhanced "overtime" rate just for working more than your part-time contracted hours? In most industries you only get paid overtime for working overtime- ie working in excess of full-time hours.

Yeah getting enhanced overtime for working over 24 hours would put everyone working 24-40 hours at a big disadvantage financially...
But anyway, I have had this before in previous shift work. You havent worked overtime as you didnt end up working your normal hours. You just squashed them into three weeks. You did 36 hours 'over' but then missed 36 hours of work.0 -
It depends on the wording of your contract but it does sound as though you didn't work overtime, you worked your normal hours but over a shorter period of time than usual, so you didn't qualify for the higher rate.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0

If you feel aggrieved remember this in the future and do no further additional hours.Its normal not to attract enhanced payments until WTE hours have been reached.0
