Property not on land registry.....who should pay the fee

Hey,
We have had some of our solicitor checks back and the property we are buying is not on the land registry. We have been informed that it is a £270 fee to register the property. I have two questions why would the property not be on it and whose responsibility is it to pay the fee ours or the sellers?

Any advice would be greatly appreciated,

    It may not be on the land registry if it has been owned by the same person for about 5 decades or if the land has recently been split?

    Who should pay - that is down to negotiation but I think it is usually the buyer especially if a new build from a developer.
