  • hi  I am having a very bad couple of days, yesterday I received a letter fro Hfx which said they had sold on my cc debt to PRA group. Hfx said the payment I could afford was too low and would be passed to their recovery dept who would contact me to discuss payment plan, think somewhere it did say it could be sold on but no discussion negotiation took place and I was not aware they were going to do this till text from PRA yesterday then letter arrived. I have read that they are not a nice company to deal with so I contacted Money advice line who said they would get their financial difficulties team to contact me this morning- no calls yet!! 
    This morning tried to log in to another cc account to check if received a response to request to continue arrangement to pay, ended up calling them and they advised debt transferred to Intrum  yesterday, she advised that they had received my correspondence in jan that they asked for financial SOA and bank stats etc and it had been agreed to July 21 to continue my arrangement , she said if I had not kept my agreement then they did not have to inform me. I have stuck to agreement and paid on time so I have made a complaint. She advised I contact them as the arrangement should still stand.I am feeling very scared,I know it’s my fault I am in this mess but have paid £7500 off my debts since last year negotiated with the companies to agree payments ( hfx were only ones who didn’t accept) but now it all feels like I’m on sinking sand and will all come crashing down.  I have been paid for an additional one off piece of work this month so £580 additional to the usual debt payment but still feels like a drop in the ocean and drowning. 
    Any advice, should I just go to moneyadvice line or stepchange? I thought I was doing okay, want to pay my debts with hopefully some settlements if I can save up ,should I save the additional this month and together with back pay may be able to clear one of the smaller cc?

  • best thing to happen to me was when my debts got sold to PRA. i asked them to send me the CCA, plenty of advice here on how to do it. they wrote back saying they were trying to get the CCA, 4 years later im still waiting, as the debt is unenforceable until they can supply it i havnt paid them a penny. 2 years more and its statute barred.

  • Update pra still haven’t come up with CCA but have started to put some money aside just in case.creation also sold my debt to intrum but they haven’t contacted me yet! Made a complaint to creation about the way they handled it, still waiting for the outcome. Steadily plodding at reducing the rest of the debt!

  • Creation passed debt to Intrum but they have not made any contact with me, should I try to make contact with them ? I am putting the payment amount I had agreed with Creation and Halifax  aside each month, however I could use this money towards other debts now. However I am thinking if I build enough of a pot for Pra and Intrum by the time they come back with CCA / contact me then I could make a settlement offer if a while till they contact me. What would you advise? All but one on 0% and am already overpaying on the one that has a low interest of 3.4%. 
    Advice please?

    Given you are not paying interest on the debts and presumably they are already defaulted I would do as you are doing and save up for settlement if they come back with the CCA. If they don't it is unenforceable.

  • Made an offer to PRA now they have supplied paperwork, they didn’t accept sadly said they wanted almost the whole debt which I don’t have.  I have offered a monthly amount which is now set up. They want me to fill in a financial budget , do I legally have to do this being as they have set up a plan on what I offered ? 
    Update have paid off just over 16,000 since I started in July 2020. Proud to say no more debt accrued , wedding is saved for and pots are building for monthly bills and car insurance money ready in pot for the annual renewal, quite proud of my achievement but still a long way to go! Oh and EF is being built up too ( slowly) sadly OH is going to be out of work at Christmas but hoping he will find employment quickly
