Hi, I've received a NTK from Parking Eye, I'm going to send them the first appeal template on day 26, would it be ok to include the following:
It was pitch black with no street lighting and NO signage lights.
Please send me a copy of your contract with the landowner authorising you to issue parking charge notices.
Please send me photo's of the vehicle leaving 3 minutes after your photo showing the vehicle entering at 7.21pm and returning 5 minutes before your photo shows the vehicle leaving at 9.10pm. The vehicle was simply dropping someone off and returning to collect, however your photos assume the vehicle was in the car park for almost 2 hours.
Any other advice would be greatly appreciated,  will Private Eye cancel this based on your experience?

There is no parking firm called Private Eye. Have another look at your documentation.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi, I've received a NTK from Private Eye
Was this personally signed by Lord Gnome? Or was it from one of their regular writers - Sylvie Krin, Lunchtime O'Booze, E.I. Addio, or E.J. Thribb?

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

They (ParkingEye, not Private Eye) have to, if it was a double visit.

What happened when you complained to the landowner?

If there was no NTD (unlikely that there was as it is very rare for ParkingLie to issue one) then there is no need to wait until day 26 before sending the appeal template in blue from the NEWBIES. Send it unaltered from the keeper save for a one liner stating that this was two separate visits and therefore no breach of parking terms occurred.
Do you have a "golden ticket" as per the example in the NEWBIES? If so then you will win at PoPLA as long as the driver is not identified.

Send an SAR to the scammers as per the NEWBIES information, requesting all your personal data including all four images of your vehicle. Include a copy of the vehicle V5C as proof of ID.

Complain to the BPA and DVLA and your MP that the keeper's personal data was obtained without reason and processed in breach of the DPA/GDPR since this was two separate visits and no breach of parking terms occurred.
Include any proof that the vehicle left and returned such as dash-cam footage or smart-'phone location tracking in your complaints.
Your complaint to the DVLA is twofold. One that ParkingLie obtained and processed the keeper's personal data without reason, and the other that the DVLA released the keeper's personal data without reason and without carrying out any checks on the requester.

DVLA complaint email addresses are ccrt@dvla.gov.uk and KADOEservice.support@dvla.gov.uk
