I’m in a difficult situation. I’m due to inherit a half share of a property and I’m looking to purchase from the other person so I will own the whole property. The other party had agreed to sell a while ago. My mortgage offer expires in January and the other party has gone very quiet. My solicitor has been useless and took two months to send a letter. I’m now massively panicking that there’s no way things will be sorted in time. I currently live in the property so I’m frightened I could end up homeless Aswell as having wasted money and time getting a mortgage 

Edited to add : it’s having a huge affect on my mental health, which isn’t great as it is. Solicitors just seem to keep pushing but get no where. Mortgage advisor says no to worry but it’s making me ill

    You have 2 months to complete before the offer expires, that is plenty of time. 
    You can always get an extension if needed potentially.

    Why would you end up homeless? They cant sell it without your agreement and you wont have to move out as you own half of it.

    The other party is difficult at best, I haven’t yet inherited the share and we still have to settle my late mums Will. I’m hoping they give me a response this week. 

    Would an extension be possible? My income hasn’t changed but I think the solicitors have dragged their feet and the other party has just not been forth coming with trying to sort things. They have previously argued about the valuation of the property, they wanted me to purchase all the contents and some other unreasonable stipulations but that was all before my mortgage application was approved.  I shall push the solicitor for more answers on Monday. I’m really worrying myself over it all 
  • If you havent inherited your half, Im presuming they havent either ? So they have nothing to sell you yet, so completion cannot take place until probate is sorted and the grant made so the executors can sign the documents to sell the house. That is where the jivvying up needs to take place.

    As Densol says, you both inherit it at the same time. 
    If you had not agreed on a price to buy their share for, how could you submit an application? 

    I think you are blowing this out of all proportion. You cant buy their share unless they agree, likewise they cant buy your share unless you agree and the property can not be sold on the open market unless you both agree.

    If the offer expires, the offer expires, just apply for a new mortgage once everything is agreed. 

    If the relative is playing awkward, just keep putting the money away into savings that you would otherwise be paying on a mortgage.

    The other relative is my father, and will already have half. It was half my mothers and half my fathers but yes we need to wait for confirmation for my half. 
    We had originally agreed that I would pay half the market value, but he has since gone quiet and hasn’t responded to any letters. It all hinges on him responding. As we cannot complete confirmation until he decides if he wants reimbursed for my mums funeral or not. He’s providing statements from the funeral, paid in cash but not where the money has come from.

    He has moved into a house with my brother and hasn’t been back to this property since he moved out. He hasn’t even returned for any of his furniture

    Maybe he’s struggling to cope with the loss of your mother? How is he? Are you able to talk to him about it? Depression makes people hide from things sometimes and maybe that’s what’s happening here?

    Unfortunately he was volatile towards her through their whole marriage and used to regularly tell her as soon as she died he was kicking us out. She had asked for a divorced but he had refused and the. Got very poorly. He does have underlying health conditions but it’s no excuse to treat people that way, especially when he knows my mental health isn’t great. I don’t see him hiding things because he’s depressed. He is very manipulative and controlling
