Holiday pay

 Now that furlough has ended and I cannot return to work until August 2021, is the company who is holding my p45 obliged to pay the holiday pay incurred during furlough.

    In what sense is the company "holding" your P45?  Are you otherwise a new starter or have they dismissed you?

    I think you are asking about holiday accrued during furlough.
  • They have told me I will be needed when exhibitions are allowed again, that's the reason for holding onto p45.
    Plus am I entitled to ask for my holiday pay accrued during furlough

    Yes, book your holidays now and there's no reason not to seek work elsewhere or sign on if you're not being paid at all.

    Why would they hold on to a P45?  Does it actually exist?  Either they have a P45 which you supplied to them from another employer so that you can be paid by them or they have dismissed you and advised HMRC of this and should therefore give you the P45 whether or not they intend to employ you next year.

    If you are not employed by them, you are entitled to pay for the holiday accrued while you were employed (whether on furlough or not) as long as they have not already paid you 100% of your pay for holiday taken during furlough or before.  

    Where are your payslips for the furlough period?
  • They have my p45 because they are the only company I work for, being in the exhibition industry we work roughly 8 months of the year. Holiday pay is added to my daily rate but furlough pay has no holiday pay added, hope this makes sense.

    But your P45 is only created when you leave an employer.

    If you want it, give notice and ask for your holidays to be paid.

    How is the holiday pay added to your daily rate?  Is it shown as a separate item or do they simply increase the basic hourly rate to 112.7% and say it includes holiday pay?

    If your furlough pay is just 80% of the basic hourly rate then you have not been paid for holidays.  Ask for holiday and you should be paid 100% of the holiday pay.

    As Savvy_Sue says, they won't have your P45 unless they have dismissed you.  As I wrote earlier, if they have dismissed you then they should send you your P45 and pay you holiday pay.
