If the contract says they will pay 5% of salary, and not 5% of qualifying earnings, then that takes priority over the statutory minimum, so they should be paying 5% on everything.1

There was a poster on here or one of the other forums who queried this with the employer and they adjusted it to the full salary, so well worth asking.Personal Responsibility - Sad but True
