  • You also have the option of not applying for your job.    The outcome of this is you either get a role anyway, or you are made redundant.

    i wouldn't get so worked up about it as you are only 10 months to retirement anyway, and by the time they get round to failing you (if this is indeed the case) then you would be only a few months away from retirement.

    take it easy and just follow the crowd.  dot the i and cross the t and yawn.  it will all be over soon and you can enjoy your retirement in peace and say good bye to having to work ever again  :)
    Retirement is not the be all and end all, nor is it the goal for everyone. Especially if people want to continue to work. Thanks to the Equality Act 2010, it's now illegal to discriminate against people because of age (as in retirement age).

    If the OP wants to continue to work after retirement, then they can do. But they have to be treated like any other employee, of any other age. Not everyone can actually afford to retire these days. Have you seen the state pension lately?!

    not sure if this is the case?  think I forfeit my rights to redundancy if I don't apply?

    No - not all OP's years of service count. Statutory redundancy is calculated:

    • half a week's pay for each year of employment up to the age of 22;
    • one week's pay for each year of employment between the ages of 22 and 40;
    • one and a half week's pay for each year of employment over the age of 41;
    • a maximum of 20 years' employment can be taken into account; and
    • there is a statutory maximum limit to a week's pay. This is set annually and is currently £538 per week (as of April 2020).

    The maximum payment under the statutory scheme is therefore currently £16,140 (i.e. 30 weeks at £538).

    As already pointed out there is no set retirement age in most professions now. You might be planning to retire in 10 months but it's irrelevant to any redundancy/restructuring process.
    Its important to realise you already have a job with the company. You do not have to apply for another one just because it suits management for you to do so. You ask if not applying would effect any redundancy payment. In fact the opposite is true, applying for a position makes it very hard to say its not suitable later. Not applying puts the onus on the company to either make you redundant or offer you something suitable.
    In your position I'd politely decline to apply for anything and let things take their course. There's no need to get stressed because it will cost you next to nothing either way. In fact, being able to effectively retire earlier than planned and avoid the covid 2nd wave at your age could be highly beneficial.

    If they are restructuring but maintain they are not making redundancies one meaning of this is they want to move one of the three of you onto a different role.  But it seems a bit off that they wouldn't have said this if this is the case, or made some indication of what the other role might be.

    No you don’t. You would remain an employee unless made redundant.  You could call Acas to ask the question if you’re in doubt.

    Thanks so much!  So is it that if I apply for one of the two roles (out of 3 candidates) and I'm not successful I would be either redundant or put at risk (so still employed until I retire in Sept 2021)  and if I refuse to apply then I am still employed and 'at risk' of redundancy?  So therefore a win/win situation for me?  I really need to get to the end of August next year to benefit fully from my final salary pension scheme (still one of the lucky one's I know in this respect) but I've had a significant pay rise this year so will impact my pension amount a lot if I get a full 12 months in at this salary.  Feeling bad I have worked really hard all these years and don't want my modest 'golden ticket' snatched away at the last minute.  I will go through the process as necessary whatever it is if it comes to that.  Just feel slapped in my face a bit after years of hard work.  Thanks for your advice

    If you apply and aren’t successful the employer could offer a suitable alternative role (if there is one), or make you redundant.  If you don’t apply you either keep existing role, accept a suitable alternative (if there is one) or the employer makes you redundant.  September 2021 quite a long time away, so if it’s important that you remain employed on current salary until then,  it might be worth applying for your role.
