Looking for some advice if possible. I am currently off work -I had heart failure earlier in the year and then suffered a stroke and Ive been off work for 16 weeks. I should go onto SSP but Ive not been told this as Ive had no contact with anyone at work (I will know for sure when I get my wages at the end of the month). During my time off we have merged with another company and since the merger our original HR no longer exist. Should the company send me forms to fill in or do I automatically go onto SSP. I was told someone would contact me but no one has.
Any advice would be appreciated.

Impossible to say as it's down to the company policy.

Provided you followed the requirements of your employer regarding notifying sickness and providing any medical certs that they wanted then you should have been on SSP from the fourth day of your sickness or earlier if you have a linking PIW. I assume that you have been receiving company sick pay which if the amount due from this is greater than the SSP rate then that fulfils the company SSP requirements. Your employer should still be recording SSP as when you reach the end of your SSP entitlement they should issue an SSP1 form and return any med certs that cover you after SSP ends for you to claim Employment and Support Allowance.0

thank you. i understand that but ive not been given details of the new policies - we have (merged) during my time off - I dont even know who HR are or where they are based. I do know that before we merged HR would send you the form to fill out but my 16 weeks were up last week and Ive heard nothing.0

The rules of SSP only require your employer to notify you if they are not going to pay you. There is a form SSP1 which should be issued when you first advised your employer that you were sick if they were not going to pay SSP or as soon as possible if they are going to stop paying SSP. If your employer is not paying SSP and has not sent you a form giving the reason why then you can follow the procedure for disagreeing with their decision here ....bettydaviseyes said:thank you. i understand that but ive not been given details of the new policies - we have (merged) during my time off - I dont even know who HR are or where they are based. Talk to your employer if you think:
- their decision not to pay you SSP is wrong
- you’re not getting the right amount of SSP
You can ask them for a reason.
If this does not sort the problem, contact the HMRC Statutory Payment Disputes Team.
