Financed Car was crashed into, only have third party fire and theft a

Hi guys 

i need advice, my car (Peugeot 107) was crashed into by a cab driver on Friday on my way to work, it flipped and the sides were damaged as well as the roof, I’m pretty sure it’s a write off, it’s on finance and only just got it. Insurance is third party fire and theft, I don’t know what to do because if the cab driver refuses to take blame, I’ll be stuck with no car and paying finance on it as well as insurance too. What do I do guys? Can I change my insurance now to fully comp and they fix it or is that fraud? I’m so lost, I do have motor legal protection and I have lost two days of work, whiplash and pain in my body but I just want a new car, I feel powerless and it’s only been two days. I’m sorry to vent, genuinely confused and very annoyed.

    Yes of course its fraud .Date of accident is now known by the motor insurance database .

    You will have to wait for the other party to settle or not .
    Suggest you contact finance company regarding payments ,dont just default .

    Your only option would be to claim off the other party.

    Begs the question why you only had 3rd party F&T insurance, often it is no more expensive to have full coverage.

    You won't be able to change your insurance retrospectively, no. And it costs to change any part of your insurance policy anyway. Even if you cancel and then try to apply elsewhere it costs. And also if you try to take out insurance when your car is practically a write off, you won't be accepted.

    I'm not sure why you didn't get comprehensive insurance when the car's on finance and comp insurance is often cheaper than the cover you have. This is a really hard lesson to learn. I have a car on PCP, I'd never consider third party, fire and theft. You can't trust anyone on the roads today. Not even yourself sometimes.

    You're going to have to report this to your insurance company and hope the taxi driver's insurance will cough up. I don't think legal cover will help - unless you get into some kind of argument with the taxi driver's insurance company.

    Report it and let your insurance company fight it out. You can't really do anything else.

    Even if the other insurance company pay out, there is no guarantee it will cover the amount of finance owed on it.

    They will offer market value and this may be much lower than you still owe. Unless you have some form of GAP insurance, you will be liable to cover the shortfall.
  • It’s usually a condition of car finance that you have fully comp insurance

    If it was the other driver's fault, then let your insurance deal with it.
