  • With two children that age under no circumstances should you be looking at 50/50 now. Maybe later when the youngest is 18 but not now. The housing of the children is the courts paramount consideration. The court may also consider a mesher where you remain in the home until the children are 18, then the house is sold and your ex gets his share then

    So again speak to a family divorce  solicitor .
    Please try to keep it friendly as the only people making money will be the legal firm's if you end up sending letters to each other for the next 2/3 years.
    Can you find a suitable property with a bigger share of the equity in the house ?

    Oh I really don’t want it to be like that - I was hoping it would be amicable and we could agree on what would be best for both of us. I can get a flat here for around £80,000 so I would need a mortgage of around £60,000 my income including my salary, benefits and child maintenance would be around £2000 per month, also, I’m 30 if that makes any difference? I will speak with a financial advisor too.

    Can you not negotiate to stay in the house? Ideally buy him out and take on the mortgage on your own, but realise that might not be possible. You need to consider keeping things consistent for the kids (schools, friends etc).
    Certainly seek a good family solicitor. You can usually speak to one for half an hour or so for nothing.
    But you need to legally draw a line under his spending.
