Bank issuing Defaults when I'm actually paying

B'ham midshires keeps defaulting my account even though I am making payments. I call and complain and they give me money to say sorry and put it right. Months later it starts happening again so I call etc. 2 years this has been going on and its affecting my credit rating. 3 weeks ago was the last complaint. BM said they will look into it and get the defaults removed and they don't understand why it is happening either.
AND still this month has been defaulted and the loan payment was only made today, it goes out same day every month, im at the end of my rope now. I dont know what else to do. I did complain to ombudsman but got nowhere with them.

Hopefully you mean you're at the end of your tether, rather than rope.
Have you missed, or underpaid, any payments at all?
How many months of defaults do you currently have?
You can't complain to FOS until you've exhausted the lenders complaints process, so you need a letter of deadlock from them if they can't fix it. You may also want to complain to the ICO.

Never missed a payment. Defaults from June through to October. BM have admitted they don't know why its happening. They send me £200 and say they will be removed, and they usually are, this time they have not been removed.0

Just wondering have you ever asked them to change the repayment date from what was originally agreed?
I'm thinking say that if your original agreement had you paying on 1st monthly but you asked them to change to say the 10th then technically you could be in default every month if you have not made a payment within 31 days of last one.
(In this example 1st of one month to 10th of next is 40/41 days).0 -

Is it possible you (unintentionally) pay every single payment late? So, the very first payment was due on, say, 25th January 2009. BUT, you paid 26th January. Second payment due 25th February, you paid 26th February, etc, etc. So, although you paid every month, you also missed / late with every payment.0

No they told me to pay that date, its been that date since it began.
Paying off extra each month wont stop the defaults, I already pay more than I should.

Send a written complaint, they have 8 weeks to resolve the issue for you.If they don`t do so to your satisfaction, then escalate to the FOS .The complaints process is there to be used, an investigation by the FOS will likely find the cause and result in further compensation i would say.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
