Mortgage Deeds

Hi, I bought my property on my own in 2004. I paid £100k deposit when I bought the property. from 2004 until 2011 i paid the mortgage on my own. I married in 2011 and divorced in 2016. during this time my ex-huband conbtributed mininally towards the mortgage as it was interest only. When we seperated in 2016 i continued to solely pay the mortgage and continue to currently also will bills and maintenance of the property. I know wish to sell the house and would like to get my ex husband removed from the property deeds. I feel that I have always solely paid the mortgage and feel that my ex husband should not be entitled to any of the equity in the property. What chances do I have of a successful outcome in my favour and what steps do I need to take if he is non compliant in my request to get him removed?

    Was the property included in the divorce settlement?

    When did you put your ex on the mortgage / deeds? As you haven't mentioned that.
    Mortgage started 2020, aiming to clear 31/12/2029.

    Hi, No unfortunaltey not.
    There's your starting point. Speak to a solicitor and start the process of obtaining a financial consent order.  Should have been dealt with at the time you divorced. Unfortunately the situation isn't as black and white as you believe.

    I had the same issue as you as I didn't include the house in the divorce. I did the divorce online by myself. However, we had bought the property together from the start.
    As described above, I had to get a financial consent order done through a solicitor. You ex-husband will definitely be entitled to a pay out. We managed to keep it out of court as i agreed to buy him out and pay him half the equity on the house. It was still a costly experience though.
