So confused with Bankruptcy!

Hi all!
So I have been advised by Stepchange that my best/only course of action I have (realistically) is to go bankrupt. If I may, I have some questions that I've asked and researched but keep getting different answers for so hoping you knowledgeable lot can help!

I need to split my income & expenditure from my partner's. What do I do about our Universal Credit payment? Stepchange suggested put it all under my partner's and all relevant expenditure (rent, household bills, council tax etc)

Within the Universal Credit is a carers element for myself caring for one of our daughters full time. Should that still go under my partner's income as UC complete payment?

This leaves me with only carers allowance as an income! And the odd account/expenditure under my name or by me. Does this mean ANY expenditure my partner has is not included when the OR investigates myself?

Will the OR freeze our joint as well as my personal bank account? If so, if we move all DD's and start using my partner's personal account for everything she will have under income and expenditure, will this be looked down upon by the OR?

Hope all makes sense in my questions! Thank you

Dan

Do you have any income other than benefits?

It's a long time since I saw the forms on a regular basis, but I think they ask for household income and outgoings, rather than separating them.  Unless your partner earns a lot more and has their own debt, I'm not sure why you would need to split the figures?

It is not the OR who freezes bank accounts, but the bank.  Are you both going bankrupt?  if not, the joint account could cause issues for your partner as they will be liable for any overdraft, etc, and you would also be financially linked.

If all your income is benefit income then it's all academic as you won't get an  income payment arrangement

Your bank may or may not freeze the account. Given the uncertainty it would make sense for you both to use your partner's account till it all settles down

How much debt do you have?
  • I would get a new bank account. I am currently in a DRO and Lloyds froze my husband and I's joint account even though the debt was nothing to do with my husband (my debt was with Lloyds).
