Ssp

I am currently ill an unable to go to work therefore my employers are paying me ssp, it looks like it may be long term and at Christmas we have a two week shut down so would i get holiday pay for the two weeks or still receive ssp, also if i'm still sick after 28 weeks when the ssp runs out will i get my holiday pay then

    If you're still sick when SSP runs out you will need to go onto ESA. That's what I did last year. I eventually left work and got my holiday pay on leaving. If I'd gone back I'd have taken all the leave I'd accrued then.

    That is up to your employer. You cannot lose your statutory holiday entitlement (28 days per year if full time) as a result of being off sick. So either they let you take the two weeks as holiday (and get full pay) or they make you stay on SSP, in which case they must let you take to holiday at some point in the future.

    It is common, but not obligatory, to allow staff who are long term sick and not getting paid to use holiday from time to time so as to get some days or weeks of pay. However then don't have to. They could insist that you can only take the holiday after you are fit enough to return to work. If you don't return to work for whatever reason then any untaken holiday must be paid in lieu.

    All of that applies to your statutory holiday (28 days per year). If you get more holiday than that then special rules may apply to the additional days including possibly forfeiting them.
