Hello there, first post hope I am in the correct place.
I have received an email today from Capquestin first one since a few in 2014, chasing an old loan I had defaulted on in 2012 from Lloyd’s Bank. I haven’t made any contact with Capquest or Lloyd’s since the default and it’s not on my credit file. They are currently asking me to phone to discuss an offer or payment plan, however I thought this would now be Statued Barred and was going to write and say so but have recently remembered in late 2014/early 2015 I’m not sure when without trying to find the paperwork lloyds sent me a letter to say due to some paperwork issue (apparently there were a few banks that had to do this) they owed me £249 off this loan and it would be taken off the balance. I didn’t reply but now I’m wondering if that will show as a payment stopping it being statued Barred even though I didn’t make it the bank did, any thoughts please on if I can still go down the SB route. For it to affect the limitation period, you would have to make any payment.
You have no control over what any 3rd party does, so the debt should be statue barred yes.
