Paid 10 months after leaving company

Hello all,
I've had a phone call from the accountancy firm of an employer I left 10 months ago. I was paid a wage packet a few days ago from the ex-employer due to a 'banking glitch' and they have asked me to transfer the money back. I am just wondering if anyone knows what my rights are regarding this. It's not like they can reclaim the money through my wages, and it's been a long time since I've worked for them and had my final salary. Everything online is about people being overpaid while working, so any advice on this would appreciated.

You have no 'rights' if you received cash to which you are not entitled. Why on earth do you think you would? Just return it.
Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

You weren't paid. You received money in error. Pay it back. End of story.
  • The money was paid in error and must be returned.  Think about it the other way - if your bank took £X from your account due to a 'glitch' would you just shrug your shoulders and say 'oh well, their money now' or would you expect them to pay it back?

Well if I accidentally bank transferred the money to the ex-employer, I wouldn't have a right to get it back, I believe. I'd just like to keep the money obviously, I didn't have a good experience with this employer at all and we could all do with a bit of extra cash.

Just wanted to know if anyone had dealt with this before as there isn't much easily googleable advice, as it's mostly to do with people still working at the company and refusing to pay back overpaid wages.

you have to pay it back.  if you don't they will take you to court to claim it back and you will have to pay the court fees and their reasonable costs for attending court if this is needed.

It's basically theft - keep it = enjoy the criminal record....

That's ok then.  The precise regulatory wording is -

    14. 1. 4 If you accidentally receive funds to which you are not entitled, you will repay said funds to the originator within a reasonable timescale unless a) you don't want to or b) you could do with a bit of extra cash.

Happened to my husband and to a friend of mine. Yes you do have to pay it back, no you have no right to keep the money, yes they can take you to court if you decide to be awkward about it.
