Help with RECOVERING money owed .He defaulted on CCJ!

Options
I am a pensioner and in 2018 a builder did some shoddy work on my roof. After months of fobbing me off he agread an amount by a set date, and then didnt pay it. Eventually a couple of months ago it went to the Country Court. He was warned by the Judge that if he defaulted he would be in Contempt of Courth and the Judge ordered costs and interest against him. As he pleased poverty it was set that he should pay me fifty pounds a week. He has now stopped paying that. I am furious. I have had to pay another roofer to come and do remedial work so am out of pocket. I could do with the money right now quite frankly. I think I can apply for a Warrent of Execution or something for the Bailiff to deal with it. I have found the online form. My son thinks I should just give up as it will be too much hassle, but I feel quite angry about the way he treated me. I am going to have to pay a fee of 70 pounds I think, which will be added to his debt. I can never understand why people behave like this. I know he has plenty of work at the moment. He is South African and bolshy and seems to think he can treat me in a dismissive way, I suspect because I am a lone woman. He even phoned me up saying I was to send him a weekly invoice and provide a weekly receipt. I refused to do that, and as he was stroppy have blocked him on  my phone. Can anyone advise me about this Bailiff action? Can I apply for the whole amount owed in one lot? And can I apply for interest until he pays the debt? If so do I have to calculate it? I really feel I cant allow him to get away with it, as this behaviour will be rewarded. I would be grateful for any advice about the process as I dont want to have to pay for legal advice. Thanks

  • Pleaded poverty. He had had a heart attack, flu, had his mobile stolen so couldnt contact me, his mother in Law was terminally ill, his mother in Law died and he had to pay for the funeral, you name it. The Judge was having none of it!
  • The million dollar question is does he have any assets? Forget about vans, tools etc as likely to be on finance. Where does he live? What car does he drive?
If it looks like he is renting a property and driving around in an Austen Allegro then probably nothing worth going for!
Have a look at his facebook posts - usually can glean lots of info from that!
  • Yes he owns his own house

You can escalate the matter to the high court for a fee of around £60.
DCBL, the chaps off the telly, will call on him, covid permitting, and get what your owed, if he has it.
Google "HCEO - Cant pay we`ll take it away".

If he knows the system he may be able to defeat a bailiff of whatever flavour.
You know he owns his house - you could stick a charging order on it.
If he owes over 5k, why not hit him with a statutory demand?
  • His being South African is not relevant.
