Discretionary Bonus becomes Contractural

Hi , after receiving a “ discretionary bonus “ for 20 years I TUPE’d to a new company . The new company will not pay this bonus as it’s consider discretionary and my grade have no bonus entitlement discretionary or otherwise . I believe that after receiving the bonus for so many years it should be considered a contracted benefit due to “ custom and practice “ . Any thoughts or Am i wasting my time taking HR lawyer advise ?

I think you’re wasting your time a bonus is very rarely contractual.A similar thing happened to some of my colleagues and they all lost their bonus as part of TUPE.This is a bit awkward when I sit next to some of them and still get mine!1

You're wasting your time. People love this custom and practice argument, but normally it needs to have gone on for much longer than 20 years AND the contract is silent on the point (as opposed to indicating that it is discretionary).Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!0
