Letters 2 & 3 to DCA

Hi, I am a little confused.
I am ready (6th Dec) to send letter 2 to Robinson Way & Co but on reading letter 3 I am a little confused.
In letter 2 you are asking them to remove all your details from their files etc but then in letter 3 you are asking them to refund all payments which you made to them.
Am I being thick, it looks like if they were to comply with letter 2 and delete you then they wouldn't be able to carry out your request in letter 3.
Can someone help my little brain get itself around this.

good to hear from you.
I have just been reading about your problems with RM. next time you go in the post office, I would get a claim form and demand compensation for lousy service.
Is there a date on the letter RW sent you (received 27.11). if not, I reckon that was sent out on 23 11 and they must have had your letter by 20.11.
So send the letter weller put up on you other thread (post41?) as this indicates that the debt is in dispute. At that point stop paying them. Allowing for slight delays in the post, I would mail that out on Friday this week.
If they do not come back with the CCA by January 7, you can either tell them that you are never ever going to pay them again. bogoff, take all reference to me off your systems and do not send this debt to anyone else (data protection). Or if you are brave (and weller has done this) you can demand that they refund you what you paid as well.If you've have not made a mistake, you've made nothing0 -

You are right but you can be assured that this lot will not delete your file the first time you request it .If you've have not made a mistake, you've made nothing0 -

I was due to pay them yesterday but was advised by Rog2 (I think) not to make the payment as because I had already started the process I had put the debt in dispute.
Do you think I was wrong not to make the payment for this month?
Still waiting for RM to tell me when the letter was delivered, they said they cannot look into it until the 14th Dec as they are entitled to that long to produce the signature!!!
I can't believe the postal system sometimes, and I actually told the assistant on the phone today as much.
All she said was that if I wanted a guaranteed delivery service I should of sent it Special Delivery!!!! (at a cost of £4 something) typical!!!0 -

I am expecting a letter any day from them telling me I haven't paid and they are going to take me to court.
With you guys behind me though I am no longer scared of people like them.

If they want to take you to court, they have to produce the signed CCA first.
What you may get is a letter telling you that your account has been referred to solicitors, collection, investigation etc for reconsideration. And that any of the following alternatives would be considered .. including court, bailiffs and visits to your home.
Certainly, they might be considered, but they will not be actioned unless they have proof that you owe them the money (the CCA and letter of assignment). The other one will be some last minute discount deal.
