Another Amigo Loans Question

Hi,
Last month my mother in law died.  She was in the process of claiming against amigo loans - she had stood as guarantor for my sister in law on a number of loans.  We only found out about this a few months before her death.  It transpires that my sister in law had left her mum to foot the bills.  I think the basis of her complaint was that the affordability checks hadn't been carried out.  She was on a state pension and had pre existing other debts and there was no way she could afford the £230+ per month for the loan.  The amount she had on credit cards is roughly what she has paid to amigo loans over the last few years.  We are now dealing with her estate.  My question is will they stop the ball rolling on her claim once they find out that she has died?  Can the executor of the will (my wife) be substituted as the contact for the claim so that any refund can go towards paying off the other debts she had built up paying this loan?

  • When somebody dies debt dies with them UNLESS there is money left in the estate.
  • There is money in the estate so the debts will be paid. She was convinced that she was due a refund. I was just wondering if her death means amigo get off the hook for mis selling.
  • Your question might be better placed on the Deaths, Funerals & Probates board.  My take would be that the mis-selling claim and any eventual payout would be an asset of the estate and that the executor should be able to see it through.  However, I am not a lawyer.

    The Financial Ombudsman will consider complaints by the executor on behalf of the deceased so see no reason why she couldnt. Obviously any compensation awarded would be paid to the estate rather than her but you already knew that.
