    The waiting period is 3 full assessment periods, with the LCWRA element starting from the 4th assessment period. This is providing there were no gaps in any of your fit notes.
    Backdated money can take between 2-8 weeks, sometimes longer and the same amount of time to put your award into payment.

    I am not clear whether or not your Fit Notes are continuous or not.
    Hi so basically in December 2018 ..
    I then provided another fit note in March and unfortunately I then developed epilepsy in April .. 
    I then submitted another fit note in July and October 2019 plus another fit note in January 2020. 
    If your Fit Notes are continuous, your claim started in December 2018 and you received your first payment in January then the LCWRA element would be payable with the UC payment in April and thereafter.

    There's no "silly rule" they will already know your award because they awarded it before the hearing took place. Can you confirm if they were any gaps in your fit notes?

    There appears to be a 4 day gap in April 2019 but given that they have accepted LCW from 1/04/209 and LCWRA is presumably now backdated to 01/04/2020 they may treat your period of sickness as continuous. 
    What was the actual UC claim start date and what day of the month are you paid?

    So assuming your health condition is treated as continuous the LCWRA is payable from the payment on 2nd May 2019.

    As you were eventually awarded by DWP it may not take as long as i previously advised but may still take a few weeks. backdated money is often paid at a different time to your usual monthly payment. I'd give it at least a few weeks before contacting them.

    Ok I’ve actually already put a message on my journal basically saying that I understand what I should be entitled to when it comes to backdating eg dates, amounts etc and if they have any idea when this should be payed, just so it’s on my journal and they can’t say well you didn’t get in touch etc. 
    So now I will leave it a few weeks before contacting them again. 
    Thanks very much for your help, honestly it’s really difficult to get any sort of useful information like this from UC, DWP, local job centre etc!

    Perfect. Ask the question on your journal, put the info you want in writing, and then no one can say they didn't know or that you didn't ask.
    You can now give your Case Manager a friendly nudge on your journal for updates from time to time, but you will probably find out quicker than them as a letter will be uploaded to your journal the moment back payment is made notifying you. Until then, there's really nothing they can tell you other than it hasn't been done yet (which you already know). Obviously if weeks pass, give them a nudge.

    Yes thanks I think that’s the best and only real thing that I can do right now and I’m very used to giving my case manager a weekly nudge as I got used to it when I was waiting for the results from my health assessment, then the reconsideration, then going to tribunal haha yes I’m very used to chasing things up with them.

  • Hi, I am new here and not sure if I am posting in the right place.
    I have been on lcw for roughly 3 years, then they asked me to go to an assessment roughly march 2020 but I handed in my evidence in January 2020. my assessments got canceled 3 times till June this year, which I passed for lcwra and got the extra money for that month. They are saying I am not due to backdated money which seems unfair, as if my assessment had went ahead last year I would of been receiving the extra money for that time. Thank you
