as he only has 2 months left of his secondment, this would have been important information to put into the original post! it is a bit too late now to be asking what are the risks to him when he is on his way back.Frosty1887 said:

to answer your question about whether this is legal. i believe it is legal as the last company i worked for was a consultancy so employees were often seconded to work for clients and the company got a cut from the client. they came and go between clients and back to our office to work as a standard process. it was never a problem.
in your case, i guess because of the current situation with covid, things are changing fast and we are working in an uncertain environment, the employer may not yet have a role for him to return to, or they are waiting for him to come back first before they deal with his new role. we have had people employed in our office without any work but they are still paid anyway until work is found for them.0 -
