    You can claim the benefit (i.e. NI credits) without actually receiving the payments.

    Take the money, put in a savings account (I know it rubbish interest at the mo) Pay back at the end of the year, any difference you keep. You cannot retrospectively claim.

    You will and are liable i'm afraid. Ignorance (and I don't mean you are ignorant) is not an excuse for HMRC. But many have fallen foul of this so you aren't alone.
    It always was and remains a nonsense tax. For the first 4 years you couldn't even legally find out if your spouse/partner was claiming it. At least they finally fixed that and you now can.
    I'm sure HMRC will allow a payment plan, and if you can and your salary is at a level where by pension payments etc you can reduce it, do so.
    It may seem unfair but it is what it is as they say. I still find the fact a couple earning 50k each can receive the benefit of it but a couple where only one works and earns 60k can't, totally bonkers!

    Never will, it's been fully known about for 7 years, not done anything about it so far so I don't think they ever will (nor have they increased the level the tax comes in at by inflation!)
