CMS- No Annual Renewal Yet?

Posting on behalf of my brother who is not happy to post his own posts but is happy to let me do so!
My brother has a son who he does not see, his mother doesn’t allow it and no matter how hard he’s tried, the son has not wanted to see him either. Son was 18 last November.
Brother and ex wife do not get on, he used to pay on an informal basis but she was saying she didn’t receive it, so brother set up a deduction from his salary, which he gets charged for and I believe ex gets charged for?
Brother usually gets an annual renewal in July, he did this year but only outlined one payment dated 30/7, due on 30/7 which got taken from his August salary, he has correlated that amount with the figure provided.
Letter made no mention of ongoing payment or schedule, he has no idea what his son is intending to do, we *think* he did a BTEC and would have probably got results by now. However estranged sister of ex wife says son has been working cash in hand with step dad & not going to school but he is reticent to take that as gospel.
Brother trying to get hold of CMS, they keep
saying they’ll find out and call him
back but as yet nothing and as far as I know he’s not had anything in his online account.
 I used to be the go between for him
and the ex and I suspect she’s trying to find out what’s better financially for her! We hope son was getting benefit of the money brother was sending....
I am assuming that they will get in touch when it is known what son is doing following leaving secondary education?

    There is a lot of unneccesary waffle in there, thing is it goes by logic not emotion, if the dependant is registered for a BTEC then that is not classed as higher education until maybe HNC, definately HND.
    No point worrying what the other party maybe thinking, just make sure you have contributed with no arrears, then there is little to dispute.

    the BTEC was *supposedly* at school sixth form I would assume this classes as sixth form education? According to CMS othe party was receiving child benefits 
    Tried calling CMS again they said they’ll call back at end of the week!

    Aim for 19th birthday or thereabouts.

    His course at 6th form would have finished, his mum would have got a letter telling her that the child benefit was stopping on 31st August. If he was then doing another course she could tell them and continue to get child benefit and then the cms will continue depending on the course.
    Have the cms said why the annual review only had 1 payment on it ? It sounds like the case is to close on 31 August

  • As far as I know the annual review is July/August anyway but I could be wrong.
    I usually scan/ upload documents for him but this only had one payment on. The payment was due the same day as the letter was issued
  • that is strange, we had our annual review in July and it had a full years worth of payments. Said child is 18 so same schooling year as your nephew.

    yeah or his course has finished and he isnt doing another one, either way it seems her child benefit has stopped and therefore no longer entitled to maintenance.
