Joint Mortgage Renewal After Separation

Options
I have been separated and living apart from my wife for 27 months now. two years ago I was happy to sign to renew the mortgage and give time to sort things out, maybe even give time for a reconciliation. However, things went from bad to worse, I've now met someone else and nothing has been sorted, despite my best efforts. Now it is due for renewal again and I made it clear that I wasn't going to tie myself into another new deal, as my financial situation is still frozen while sitting in rented accommodation. I also rang the mortgage provider and made them aware of the situation, just in case she would try and push something through without my knowledge... I was assured this wouldn't happen. I called the mortgage provider again the day before the deal ran out, just to check again, only to be told that she had made an online application and it had all been approved, without my knowledge! Of course I have lodged a complaint and asked for it to be reversed, but I just cannot believe that this happened in the first place, and want to warn others.

    Start divorce proceedings.
Are there children? If not as part of the divorce proceedings have it so the house has to get sold or she buys you out within a certain time.

There is usually no lender involvement when picking a new fix online, it's all automated.
Mortgage started 2020, aiming to clear 31/12/2029.
  • Shouldn't have been able to get through to automated renewal when they were prewarned. They should have had something in place to block the application.
  • No she should not
it should have been noted on the records
my partner has this situation and she can do nothing unless Halifax speak to him directly ( after writing to him first ) and they assure themselves he has properly agreed
in addition to the complaint, divorce finances need sorting as this wont go away
  • I've asked for a transcript of the phonecalls when they assured me this wouldn't happen.
I wanted to go down the divorce by agreement route, but she's been stalling on the agreement, so just going to petition on grounds of unreasonable behaviour.
