I am currently working as a Covid tester at an RST, it is a Serco run site, so half the staff are Servo the other half are agency including me.

Many agency staff have worked longer than 12 weeks but are not receiving same rights as permanent employees in terms of guaranteed hours etc.

I am approaching 12 weeks and before i ask the agency myself i wondered if some kind of exemption applies because this job has an uncertain end date.

Can agency workers be denied comparative rights to permanent employees in certain situations?

You are not entitled to guaranteed  hours as an agency  worker that is one if the main reasons companies  use agency's.
You are entitled to equal pay, holiday and pension after 12 weeks
