, I have been on furlough since march my employer has got new staff while I'm on furlough, what he calls his covid cleaners which I understand but my question is can he make us redundent and then keep his new staff.

    It depends. Are the new staff doing the same job as you?
    It is roles, not individuals, who are redundant, so if your employer has taken on new people to cover the same work you were doing, and then seeks to make you redundant, then it is unlikely that  he can do so, as your roles are not redundant.

    However, if they are doing different work from you then then that would nit prevent your role from being redundant, even though the company might be expanding in other areas, although if the work is similar there might be an issue over whether they should have offered you the role as suitable alternative rather than making you redundant. This may depend on the timing, too. 

    Has your employer said that you are at risk of redundancy?

  • I've only worked there since October 2019, they are doing the same job as me, going back a few weeks ago we were offered voluntary  redundancy but because I've not been there long enough I refused to sign it, we have not heard anything since that.

    With less than two years service you can be "let go" just by paying your contractual notice (or one week's statutory notice if no longer contractual period has been agreed). There is no entitlement to redundancy pay I'm afraid.
