Unpaid holiday and job relocation

My son has been employed by a garage as a mechanic since he was 16 part time. He is now 19. The garage has changed hands in the past year but my son was taken on full-time after completely his college course.

My son struggles with being on time, he has a sleep problem, and wasn't so much of an issue when living at home, as I always got him up. However he recently moved out and I believe he had a verbal warning for wing late (but nothing to show for it) however, Friday he was called to a meeting on Monday and was told that he had to take 1 months unpaid holiday and when he comes back his job will be in a new town. (From one town to their other garage in another town, a train ride). They know he doesnt drive and can't get there. They also know that he was due to take holiday this week and therefore we believe he will now not be paid for this. So right now he has no money for rent or food. 

Is this constructive dismissal or just reorganising of the business and unfortunately my son has been caught in it. I'm not sure whatvto advise as technically they haven't sacked him so i don't think he can claim any benefit.

The added difficulty is he does not have a copy of his contract, which i have asked him to get when he collects his tools tomorrow.
Any advice would be appreciated.

    He definitely needs his contract, although there may well be a 'lay-off' clause in there. 

    Why can't he get to the other garage on the train? 

    Too much to hope he's in a union? 

    There is nothing to stop him looking for another job during his unpaid holiday.

  • If he's not in a union, contact ACAS for advice - I don't think that's something they can do, in regard to the unpaid holiday, although he definitely needs to have a look at his contract. If they say they're unable to give it to him, he could ask for a copy through a Subject Access Request.

    Has your son been diagnosed with a sleep disorder or is it simply a case that his life style makes it difficult to get up in the morning? 
    Whatever happens with the current job, his inability to get to work on time is something which needs to be addressed.  No employer will put up with an employee repeatedly turning up late.
