CCJ ADVICE PLEASE
Hi, I took out a payday loan with cash float (Western circle) in 2016 I defaulted and got into trouble with them in NOV 2018 they took me to court and obviously I lost despite my plea to court for help against this ruthless company my defence was “struck out” anyway I was issued with a CCJ and awaited recovery action from Cashfloat however I never received a single shred of communication from cashfloat since The judgment however it remained only as default on my credit filed and now today I’ve received a letter from cashfloat saying that they are applying for a CCJ due to non payment.
Can they do this?

The letter you got most likely is telling you they're going to take enforcement action on the CCJ because you've not paid it. This isn't issuing a new CCJ, it's getting a warrant of execution for the existing unpaid CCJ from the court to allow them to recover the money either by a deduction from your wages, freezing money in your bank account, putting a charge on your property if you own your home or sending bailiffs round to remove goods.Just because you've had a CCJ awarded against you doesn't mean you don't need to repay the money. If anything there is an even more urgent need to repay it because of the above.0

Why waste money on enforcement just after you've been issued a CCJ when they can wait a few years (up to 6 years), see your finances are in better shape and then pay for enforcement when there's a better chance you have a job, a house you've bought or goods they can levy a charge against? If I was owed money and got a CCJ I'd definitely wait until I thought there was a higher chance of getting my money back before paying to do so.
