D.W. Gyms taken over.

Good afternoon,
Following DW going into administration, I am advised that our local gym has been taken over by an outfit called SDI Fitness. (Part of the Frazer Group.)  I cancelled my D.D when DW went into liquidation. Have they any right to "sell" my membership to another company. Presumably all previous deals are cancelled and SDI will need to ask me to sign a new contract and DD authority. I just got the impression DW are trying to bounce me on to the new company without my permission. What do you think? Thank you.
David.

I am curious as well, as I signed up in September for 12 month contract but as things have changed over the period so far, I am struggling to pay the subs for 3 of us now, and curious to know whether this means my contract is void as because it was frozen I still have about 6 months left for 3 of us.

It's generally fine for a transfer of the contract to take place, as long as the main terms are carried over.

You might even find the issue addressed in your current contract.

    David.

    Its not an outfit.
Its Sports Direct, Mr Ashley has been at work again.

Thank you for your reply. From that I assume that the gym has a right to start collecting my DD again when it opens and my cancelling it without notice is a breach of my contract? Actually my contract is with previous gym called Carrefour - for what it's worth. They were taken over by D.W. Pass the parcel......
DCF :- I don't understand your reply. Are you saying that being taken over by Sports Direct is a good thing or a bad thing?  I know he has a bit of a rep.
  • Just an additional thought - the final explanatory letter from D.W.Gyms did state that if I didn't transfer to another DW club, unaffected by the closures, then my membership would be cancelled.

That means that your contract will end if you don't transfer anywhere else and that the new gym will start from scratch.

Thanks. I think it should do. Not all DW's closed and in their final explanatory Email I don't think they delineated between the gyms that were open and the gyms that were completely closed. It remains to be seen as whether the new owners make the distinction.
