Urgent Help Needed in Regards to Termination Letter

Hi all, 
I have been made redundant from my role recently. I was given a termination date of the end of June but it says on the letter I am being paid furlough til the end of July. Therefore, would my termination not be the end of July when my last payment was made? 

I was also in my probation period although I had passed the probation time. I was told verbally that I had not been passed as I had had a sick day during the probation period. I thought this was very unfair. I however never received my letter saying I had not passed which I was told I would receive so have no proof that I passed or failed this probation. I am a little lost therefore as I have been paid notice for someone in probation although my probation would have come to an end already even if it was extended. Unfortunately I was furloughed during this time. 
Any advice would be great as I unsure as to where I stand.

  • tbh even if you had passed your probation, with less than two years service your contract can be terminated quite easily.
    I'm presuming that you have been let go due to redundancy rather than probation and this is all you need to put on any future applications.

    With less than 2 years I don't see you have any case. Get looking for another job.

    The OP is entitled to his contractual notice period. As I read it, that would be longer if he was deemed to have "passed" probation. He could, in theory at least, bring a tribunal claim on that point as it is not subject to the often quoted "two year rule".

    I assume we are talking about say a month's notice rather that the statutory week's notice? If so it is three weeks pay so well worth pursuing. It is the sort of amount that a company may decide to settle if the ex employee looks serious as it would cost them that and more in staff time and legal costs to defend.

    Have you asked your employer for clarification? Set out what you believe your notice period to be and what you think the correct pay is, ask them to confirm They will pay the correct amount.
    what are the notice periods?

    It may have been free but it wasn't correct in this particular case!

    The point in dispute is whether probation had ended. If it had then the OP is entitled to a longer period of notice. A claim on that point (i.e wrongful dismissal / breach of contract) is not subject to the two year qualifying period needed for most unfair dismissal claims.

    In your original post you said you were informed of termination in June, but were paid (furlough) until the end of July. In this case you’ve received more than one week notice, or am I missing something?

    Legally speaking, you will be employed while you are on furlough.

    It sounds like the employer is trying to do the decent thing by putting you on furlough for a time rather than terminating you straight away.

    As you have less than 2 years' service, you can be dismissed with only 1 week's notice I'm afraid (unless a longer period is specified in your contract) and you have been given more than that, so the employer is acting lawfully.
