Bus driver and mobile phone.

A mate of mine lives opposite a bus stop. One particular driver always stops there early in the morning and proceeds to chat for ages (very loudly) on his speakerphone to his boss/mate. 
This disturbs my friend and when he tackled the driver he was told he has to talk on the speakerphone as the electrical charging system is still on when the engine is turned off, so he is technically still in charge of the vehicle. 
My mate thinks this is !!!!!! (as do I) but we can't find any legal guidance online to use to complain to the bus company. Can anyone help?

    Contact Environmental Health at your local Council, since the issue is noise disturbance at an anti-social time.

    The only time I have been aware of a local bus driver on the phone (rather than intercom to control) she physically left the driving seat and stood on the pavement.  Does the bus company let its drivers use their phones, even on speaker phone, while in control of their vehicle?

    OP said it may be that he's speaking to his boss so he's probably allowed. But he's disturbing others, and that's just not on.
