Refund of deposit

Can I get a deposit refunded?  Deposit paid on wedding dress - is a sample dress so not ordered in, just prior to lockdown. Unable to contact anyone at shop for some time. Email sent but they say they didn’t receive it.  Thought if remainder wasn’t paid within stipulated time that the deposit would be returned so ordered another dress. Shop now wanting full payment or lose deposit. No costs have been incurred by shop. They are refusing to refund deposit as they say their terms and conditions say once the time has elapsed for payment it is non refundable. They say we should have contacted them once the shop reopened. Any advice?
